3. The Service

Cultiv8 provides learning tools that may include AI-generated instruction, quizzes, practice assessments, progress tracking, and related features.

No professional advice: The Service is for educational purposes and does not provide legal, medical, or other professional advice.

4. AI outputs and accuracy

The Service may generate content using AI models.

• AI outputs can be incorrect, incomplete, or outdated.
• You are responsible for how you use outputs, including verifying correctness for high-stakes decisions.
• We do not guarantee that AI outputs are accurate or that they will lead to any specific result (including exam outcomes).

5. Purchases, subscriptions, and refunds

We may offer paid features or courses. Payment processing is handled by third-party processors (e.g., Stripe).

Refunds (if offered) are governed by any posted refund policy or offer terms presented at purchase. If there is a conflict, the purchase terms/refund policy controls.

6. Acceptable use

You agree not to:

• Use the Service for illegal, harmful, or abusive activities
• Attempt to bypass limits, exploit vulnerabilities, or disrupt the Service
• Probe, scan, or test security without authorization
• Reverse engineer or extract source code except to the extent permitted by law
• Use automated scripts or bots to create accounts, scrape, or spam
• Upload or transmit malware or malicious code
• Infringe intellectual property rights of others

We may limit, suspend, or terminate access if you violate these Terms.

7. User content

You may submit content (e.g., prompts, messages, uploaded materials) ("User Content").

• You retain ownership of your User Content.
• You grant Cultiv8 a license to host, process, transmit, and display User Content only as needed to operate and improve the Service, comply with law, and enforce policies.
• You are responsible for ensuring you have the rights to submit User Content.

8. Intellectual property

The Service, including software, design, branding, and non-user content, is owned by Cultiv8 or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business use.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if:

• You violate these Terms,
• Your use creates risk or legal exposure for us,
• We are required to do so by law.

We may retain certain information as described in the Privacy Policy, even after termination.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULTIV8 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULTIV8 WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

IN NO EVENT WILL CULTIV8'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID TO CULTIV8 IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
• $100 USD.

12. Indemnification

You agree to indemnify and hold Cultiv8 harmless from claims arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of Montana, USA, excluding conflict-of-law rules.

14. Changes to the Service or Terms

We may change the Service and update these Terms. If we make material changes, we will notify you via the Service and/or email. Continued use after changes means you accept the updated Terms.
